eNest — Privacy Policy

This Privacy Policy explains how the eNest group of companies handles personal information collected through our website at https://enestit.com (the “Site”). It should be read together with our Terms of Use and Cookie Policy. By using the Site, you agree to the practices described here. If you do not agree, please do not use the Site. 

1. Who we are

The Site is operated by the eNest group (“eNest”, “we”, “us”, or “our”), comprising: 

  • eNest USA, Inc., a Delaware corporation, 601 Walnut Street, Suite 825, Philadelphia, PA 19106, USA; and 
  • eNest Technologies Private Limited, E-261, Fifth Floor, Phase 8-B (Industrial Area), Sector 74, SAS Nagar, Mohali, Punjab 160055, India. 

For personal information collected through the Site, the eNest entity you are dealing with (or, by default, eNest USA, Inc. for visitors in the United States) acts as the controller of that information. 

2. Scope — this policy covers the website

This policy covers personal information we collect from visitors to the Site — for example, when you submit a contact or enquiry form, or as you browse. It is a business-to-business website; it does not offer user accounts, profiles, subscriptions, or online purchases, and we do not collect such information through it. 

Client and project data — including any healthcare, clinical, or patient data we may process when delivering services to a client — is not collected through this Site and is not governed by this policy. Such data is handled only under the separate services agreement with the client and, where applicable, a Business Associate Agreement (BAA) or data-processing agreement. Nothing in this policy should be read as describing how we handle client or patient data. 

3. Information we collect

Through the Site, we may collect: 

  • Information you give us: when you complete a contact or enquiry form or otherwise contact us — typically your name, business email address, phone number, company, and the content of your message. 
  • Information collected automatically: when you visit the Site, we and our analytics providers may collect technical data such as your IP address, device and browser type, pages viewed, referring and exit pages, and general (city/country-level) location. This is collected through cookies and similar technologies, subject to your consent — see our Cookie Policy. 

We do not seek to collect sensitive personal information (such as health, biometric, or financial-account data) through the Site, and ask that you do not submit it through our forms. 

4. How we use information, and our legal bases

We use the information above to: 

  • respond to your enquiry and communicate with you about your request or a potential engagement; 
  • operate, secure, maintain, and improve the Site; 
  • produce aggregated, anonymised analytics about how the Site is used; 
  • where you have consented, send you information about our services that may be of interest; 
  • comply with legal obligations and protect our legal rights. 

Depending on your location, our legal bases for processing are: your consent (for analytics/marketing cookies and marketing emails); our legitimate interests in responding to enquiries and running the Site securely; the steps necessary to enter into or perform a contract at your request; and compliance with legal obligations. 

5. Marketing

We will only send you marketing communications where you have agreed to receive them. You can withdraw your consent at any time by using the unsubscribe link in any marketing email or by contacting us at the address in section 11. We do not sell your personal information.

7. Sharing and international transfer

We may share personal information with: 

  • Service providers who act on our behalf (for example, website hosting, analytics, and email providers), under contracts that require them to protect it; 
  • Group companies, where necessary to respond to your enquiry — in particular between eNest USA, Inc. and eNest Technologies Private Limited; 
  • Authorities or others where required by law, to protect our rights, or to prevent fraud or harm. 

eNest operates in both the United States and India. Information collected through the Site may be transferred to, and processed in, India by eNest Technologies Private Limited under our intercompany arrangement. Where such transfers involve personal data protected by laws such as the GDPR or UK GDPR, we rely on appropriate safeguards (for example, Standard Contractual Clauses). We may also disclose personal information as part of a corporate transaction such as a merger or acquisition. 

8. Retention

We keep personal information only for as long as necessary for the purposes described above — for example, enquiry correspondence for as long as needed to deal with your request and for a reasonable period afterwards for our records — and then delete or anonymise it, unless a longer period is required by law. Different categories of data may have different retention periods. 

9. Your rights

Depending on your location, you may have the right to access the personal information we hold about you, to correct or delete it, to object to or restrict certain processing, to withdraw consent, and to data portability. To exercise any of these, contact us at the address in section 11. We will respond as required by applicable law. You may also have the right to complain to your local data-protection authority. 

10. Security and children

We use reasonable administrative, technical, physical, and organisational measures to protect personal information during transmission and storage, including access controls and restricted, password-protected servers. No method of transmission or storage is completely secure; if we become aware of a breach affecting your information, we will act as required by applicable law. We recommend you keep your own devices and credentials secure. 

The Site is intended for business and professional users and is not directed to children under 18. We do not knowingly collect personal information from children; if we learn that we have, we will delete it. 

11. Changes and contact

We may update this Privacy Policy from time to time; the “Last updated” date above shows when it was last revised. Material changes will be notified through the Site. Continued use of the Site after changes means you accept the revised policy.
